Terms of Use

1. Scope and provider

These terms apply to the iOS app “tripklar.” (“the app”). The provider is:

By creating an account or using the app, you accept these terms. Apple's terms also apply to getting the app and to all in-app purchases, in particular the Licensed Application End User License Agreement (EULA). For the purchase itself, Apple's terms take precedence.

2. What tripklar. offers

tripklar. is an app for private groups – such as couples, families and friends – to plan trips together. This includes in particular:

• creating trips with a destination, dates and travel styles,
• inviting others to a trip with an invite code,
• a shared calendar for events and activities,
• a shared and a private packing list,
• a list for collecting ideas and links,
• a budget splitter that divides shared costs,
• weather and cover photos for the destination.

tripklar. is not a tour operator, travel agent or booking platform. No travel services such as flights, accommodation or activities are booked or arranged through the app.

3. Account

You need an account, either with an email address and password or via “Sign in with Apple”. You agree to

• provide truthful information when registering,
• keep your sign-in details secret,
• let us know if you suspect someone unauthorized has access to your account.

Accounts are not transferable. You must be at least 16 years old to use the app.

4. Content in shared trips

4.1 Events, notes, expenses, packing-list items and saved links in a trip are visible to all members of that trip. Many of them can also be changed or deleted by all members, such as events and shared packing-list items. Private packing-list items are visible only to you.

4.2 You are responsible for the content you add. You make sure you're entitled to it and don't infringe anyone's rights. Don't enter personal data about people outside your travel group in free-text fields without their consent.

4.3 If you leave a trip or delete your account, some content you created (e.g. expenses) remains in the trip for the other members. See “Deleting your account” in the Privacy Policy.

4.4 You may not use tripklar. to spread unlawful, offensive or discriminatory content. If there is reasonable suspicion of a violation, we may remove individual content or suspend accounts.

5. tripklar Plus and single trips

5.1 Without a purchase you can create up to two trips of your own. Joining other people's trips is always free and unlimited, and every feature is available to everyone. For more trips of your own there are two options:

• tripklar Plus: a subscription (monthly or yearly) that lets you create as many trips of your own as you like while it is active.
• Single trip: a one-time purchase that unlocks room for one more trip of your own.

5.2 Processing, prices, duration: all purchases are made exclusively through Apple's App Store. The prices and durations shown at the time of purchase apply. A subscription renews automatically for the chosen period unless you cancel it in your Apple ID settings before it ends.

5.3 Cancellation: cancel a subscription in your Apple ID settings (Settings → [your name] → Subscriptions) or in the app under “Profile → Subscription → Manage subscription”. We have no access to your subscription and cannot cancel it for you.

5.4 Refunds: refunds are decided solely by Apple. Please send requests to reportaproblem.apple.com.

5.5 Right of withdrawal: as a consumer you generally have a 14-day right of withdrawal. For digital content such as tripklar Plus or a single trip, it ends early once you have expressly agreed to immediate provision and acknowledged that you thereby lose your right of withdrawal (Section 356(5) of the German Civil Code).

5.6 Receipts: Apple provides receipts through your Apple ID. We receive no payment data and don't issue invoices ourselves.

5.7 An active subscription does not end automatically when you delete your tripklar account. Cancel it beforehand as described in 5.3.

6. Availability

6.1 We aim to keep tripklar. available without interruption but cannot guarantee it. The app depends on third-party services, mainly Google Firebase (accounts, database), Apple (sign-in, purchases, calendar, place search), Pexels (cover photos) and Open-Meteo (weather). If these fail, some features may be temporarily unavailable.

6.2 We may adapt, extend or discontinue individual features as the app evolves, as far as this is reasonable for you.

7. Liability

7.1 We are liable without limitation for intent and gross negligence, under the German Product Liability Act, and for injury to life, body or health.

7.2 For slightly negligent breaches of essential obligations – those that make using the app possible in the first place and on which you may rely – liability is limited to the typical, foreseeable damage. Otherwise, liability for slight negligence is excluded.

7.3 We give no warranty for information from third-party services, in particular:

• Weather (Open-Meteo): forecasts and climate values are predictions or averages and don't replace an up-to-date forecast before you leave.
• Cover photos (Pexels): they are decorative and don't necessarily show the actual destination.
• Budget splitter: balances and payment suggestions are based solely on the amounts members enter themselves. The app is a calculation aid, not a binding settlement between members.

7.4 Content that other members add to a trip is the responsibility of the person who added it.

8. Ending use

8.1 You can stop using the app at any time by deleting your account under “Profile → Edit account → Delete account”.

8.2 In case of serious or repeated violations of these terms, in particular 4.4, we may suspend or delete accounts after reasonable notice.

9. Changes

If the app's features or the legal framework change significantly, we will update these terms and let you know in the app.

10. Governing law

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. As a consumer, you keep the protection of the mandatory provisions of the country where you habitually reside.
